1. Acceptance of Terms
By accessing or using WA Campaigns ("the Service"), operated by Bhayani Innovations, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
WA Campaigns is a SaaS platform that enables businesses to manage WhatsApp Business communications, including bulk campaign messaging, lead management, automated follow-ups, and inbox management via the Meta WhatsApp Business API.
3. Eligibility
You must be at least 18 years old and a registered business or authorized representative to use this Service. By using WA Campaigns, you represent that you meet these requirements.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized access to your account.
- You must provide accurate information when creating your account.
5. Acceptable Use Policy
You agree to use the Service only for lawful business communications. You must NOT use WA Campaigns to:
- Send messages to contacts who have not opted in to receive WhatsApp communications from you
- Send spam, unsolicited, or bulk promotional messages to individuals without prior consent
- Violate WhatsApp Business Policy or Meta Platform Terms
- Send misleading, fraudulent, or deceptive content
- Harass, abuse, or threaten any individuals
- Distribute malware, phishing links, or malicious content
- Violate any applicable local, national, or international law or regulation
- Impersonate any person or entity
Important: You are solely responsible for obtaining valid opt-in consent from all recipients of your WhatsApp campaigns. Failure to comply with WhatsApp's consent requirements may result in your WhatsApp Business Account being suspended by Meta.
6. WhatsApp & Meta Compliance
The Service uses the Meta WhatsApp Business Cloud API. By using this Service, you also agree to comply with:
We reserve the right to suspend or terminate your account if your usage causes our WhatsApp Business API access to be restricted or revoked by Meta.
7. Billing & Payments
Certain features of WA Campaigns may be subject to subscription fees or usage-based billing. By enabling paid features, you agree to pay all applicable fees.
- All fees are non-refundable unless otherwise stated
- We reserve the right to change pricing with 30 days' notice
- Failed payments may result in service suspension
Note: WhatsApp message fees are charged directly by Meta and are separate from any fees charged by WA Campaigns.
8. Intellectual Property
All software, design, and content comprising the WA Campaigns platform is the property of Bhayani Innovations. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
You retain ownership of your data (leads, templates, campaign content) uploaded to the platform.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that messages will be delivered by WhatsApp. Message delivery is subject to Meta's infrastructure and policies.
10. Limitation of Liability
To the fullest extent permitted by law, Bhayani Innovations shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to:
- Message delivery failures
- WhatsApp account suspension by Meta
- Loss of business or revenue
- Data loss
Our total liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim.
11. Termination
Either party may terminate the agreement at any time. We reserve the right to suspend or terminate your account immediately if you violate these Terms. Upon termination, your access to the Service will cease and your data will be deleted within 30 days per our data retention policy.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the platform. Continued use after the effective date constitutes acceptance of the updated Terms.
